2. Terms and conditions for usage of Health Oasis Services

2.1. What is Health Oasis?

Health Oasis Brand name run by Empower Consultancy FZ-LLC. It is consulting for Medical Tourism, Healthy Lifestyle, and Beauty and we support our Clients in finding the most suitable solutions for their needs in the field of Medical Tourism consulting, lifestyle consulting, and beauty consulting. Empower Consultancy is licensed under Trade License number 47005156 in Ras Al Khaimah Economic Free Zone, Ras Al Khaimah, UAE with registered address: FDBC1392, Compass Building, Al Shohada Road, AL Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates UAE.

2.2. Who can use our services?

Our services are intended for use only by independent adults (Clients) who are at least 18 years of age. Health Oasis service may also be used by adults regarding their children under the age of 18.

2.3. Services and responsibilities

Health Oasis is not a medical or healthcare institution and therefore Health Oasis does not provide any healthcare services including but not limited to: medical assessment, diagnostics, treatments, or prescriptions. None of the Health Oasis consultants works as a healthcare provider in the scope of Health Oasis services. Health Oasis services also do not apply to emergent and urgent concerns or queries.

The information and advice provided by the Health Oasis consultant should be used to increase Client’s awareness of the options Client may have available. The information and advice provided by the Health Oasis consultant are based on information that the Client has given to the Health Oasis consultant. It is Client’s responsibility to provide the Health Oasis consultant with correct and complete information as this may affect the information and advice the Health Oasis consultant gives. Any failure to do so (whether intentionally or not) may have consequences for which Health Oasis or Health Oasis consultants are not responsible.

It is the Client’s responsibility to make sure all information or advice given to the Client is fully understood. In case the Client needs additional clarifications, the Client should raise this and discuss it with the Health Oasis consultant who will seek for the best way to clarify the subject matter.

Health Oasis consultant may provide the Client with useful resources that are linked to other websites or offer leaflets provided by third parties. These links or leaflets are provided for information purposes only and should not be interpreted as an approval or endorsement of any of those linked websites, third parties, or information and services the Client may obtain from them. Health Oasis has no control over the contents of those sites, resources, or services offered by third- parties.

Health Oasis consultant may also present to the Client one or several most appropriate referral options for Client including but not limited to Clinics, Doctors, Coaches, Nutritionists, Tourist Agencies, Transportation Companies, Hotels (“The Third-Party Providers”). The client may be referred to the third-party providers Health Oasis has signed a partnership or referral agreement with (“The Partner Third-Party Provider”) or advised to be referred to any other third-party Health Oasis has no such agreements signed. The client will be informed whether a certain Third-Party is our partner or not.  Upon Clients, final choice Health Oasis will share Clients’ details with particular Third-Party Provider and Client will be referred to them or Client will be instructed on how to contact The Third-Party Provider. All Third-Party Providers (regardless of partnership status with Health Oasis) are independent providers of their specific services and Health Oasis shall not be liable in any way whatsoever for any acts or omissions of the third-party provider. Health Oasis has no control over or responsibility for The Third-Party Provider services, quality of services, turn-around times, opening hours, or their availability. The client is under no obligation to use or purchase any services from any Third-Party Provider, and the Client may always choose any other provider of his/her own choice.

To the extent permitted by the law, Health Oasis shall not be liable for any damage, loss, or liability (whether arising in contract, tort, including negligence or otherwise) arising out of or in connection with Clients use or inability to use the information, advice and/or services offered by Health Oasis at any time for any reason and/or Clients failure to comply with any law or regulation that is applicable to him/her. Health Oasis shall not be liable to Client for any loss Client suffers due to any event or circumstances beyond Health Oasis reasonable control which leads to Health Oasis services being wholly or partly unavailable, such as, but not limited to, technical breakdown, strikes, or any industrial action ( whether or not involving our employees) or communications or power failure. The above exclusions apply to any damage whether direct, indirect, special, incidental, or consequential, or consist of loss of profits, business, opportunity, or data. All of the above exclusions apply even if the Client has advised Health Oasis of the possibility of the above types of damage, loss, or liability.

2.4. Interruption of services

While every effort is made to avoid any interruptions or Health Oasis service unavailability, Health Oasis is unable to guarantee that Health Oasis services will always be available or uninterrupted. In such cases, the Health Oasis representative will make every effort to contact the Client directly or indirectly and advise of alternative services.

2.5. Suspension of services

Health Oasis reserves the right to deny any person or Client access to Health Oasis services in case that person or Client engages in any abusive, inappropriate or unlawful behavior when communicating with any of Health Oasis staff either face to face or via telephone, video call, email or any other means of communication or interaction. Any of the aforementioned behavior will be considered a breach of the T&C, and in these circumstances, Health Oasis reserves the right to terminate the provision of the services immediately upon notice.

2.6. Consultation

Appointment

Appointments can be made via info@health-oasis.com, or alternatively by WhatsApp message to +971 58 982 7174. Consultations last for 30 minutes but can be prolonged depending on the particular case and on the availability of the Health Oasis consultant. In case the Health Oasis consultant estimates additional time for consultation is needed or the Client has additional concerns or questions and Health Consultant has another scheduled obligation, a new appointment will be agreed upon with the Client. If the Client is late for an appointment by more than 10 minutes, the Health Oasis consultant reserves the right to either cancel or to continue with the appointment.

 

 

2.7. Payments

By signing this CCF, the Client is not obligated to pay any fees. In case of usage of any payable services Client will be informed and invoiced in advance, prior to the usage of the same. For Bank details please contact us directly to info@Health-oasis.com

Any third-party costs will be charged to the Client directly (or Clients’ insurer based on his/her health insurance policy terms and conditions).

2.8. Privacy, Data, and Clients Records:

Access to Health Oasis Client’s records is restricted only to Health Oasis staff. Health Oasis does not share personal or any other Client’s information for any purpose not defined in this CCF or required for providing our services unless expressly consented by the Client. Health Oasis may also use the Client’s information to review or evaluate the performance, quality, or timeliness of Health Oasis services.

Health Oasis has implemented security controls to ensure that Health Oasis systems and data are secure. These controls are continuously monitored and upgraded.

Health Oasis monitors what happens to Health Oasis Clients after they have been using Health Oasis services and/or were referred to The Third-Party Providers. This is done by follow-up consultations with Clients, collecting survey results and following up with The Partner Third-Party Providers, and gathering information on outcomes and costs related to the services provided to the Clients referred by Health Oasis. This allows Health Oasis to check on the quality of Health Oasis services, the quality of The Partner Third-Party Provider’s services, the satisfaction of our clients with services, and comparing cost-benefit ratio among our Partner Third-Party Providers. Gathering the above-mentioned information also secures Health Oasis remuneration, continuity of work, and improvement of Health Oasis services. By signing this CCF Client consents to Health Oasis processing and collecting such information and to share this between Health Oasis and Partner Third-Party Providers that are providing Client their services, if required. Health Oasis insists that all our Partner Third-Party Providers adhere to Health Oasis Privacy Policy as well as all globally applicable data privacy laws.

The client agrees that Health Oasis may send to the Client any notices regarding Health Oasis services through electronic means including but not limited to emails. These notices include but are not limited to Consultation Summaries after an appointment with dedicated Health Oasis consultant referral letters, Health Oasis offers, or offers from The Partner Third-Party Providers. Any of the notices are effective when sent by Heath Oasis, regardless of whether the Client received or read it. Please ensure you (Client) have provided Health Oasis with your accurate email address.

2.9. Complaint

For any complaint or query about Health Oasis services please don’t hesitate to contact Health Oasis by email at info@health-oasis.com  with the subject: COMPLAINT. Health Oasis representative will do his/her best to try to resolve the issue quickly in accordance with Health Oasis policies and procedures.

 

2.10. Client Consent Form Changes

Health Oasis may revise T&C’s from time to time due to various reasons including but not limited to any changes in relevant laws and regulations, any change in Health Oasis services, etc. We will notify the Client of any changes to our CCF and T&C’s to ensure the Client understands the conditions that apply at that time. The client will be notified by email. If the Client continues to use Health Oasis services after being informed about CCF changes it will mean that the Client accepts those changes.

  1. Termination

It is the Client’s right to retrieve his/her consent to the above T&Cs anytime without any reason by sending an email to info@health-oasis.com with the subject: STOP-Client’s name and Surname.

I(the Client) have fully read and understood the above agreement and it’s Terms and conditions, and I (the Client) consent to the above agreement with Health Oasis (CCF) and it’s Terms and conditions by signing this Client Consent Form.
